Intellectual property (IP) is the creative or scholarly output you create from your research or teaching activities at the university.<\/li>\n\t
IP rights are legal rights creators have over their works to limit how others use or interact with their works.<\/li>\n\t
IP rights exist in three main forms:\n\t

Trademarks<\/strong>: ensure that the source of a good or service is attributed to a particular producer. It helps ensure the public knows the origin of a good or service and helps protect the reputation of the producers of these goods and services.<\/span><\/li>\n\t\t
Patents<\/strong>: <\/span>allows an inventor to have a time-limited monopoly on their invention. It enables inventors to exclusively make, have made use, have used, sell, or have sold their patented invention.<\/span><\/li>\n\t\t

Copyright is a legal framework to ensure credit is given to the appropriate creators\/entity of the output.

Accurate copyright means the copyright holder can determine the terms of use for the research outputs, including opportunities to sell, share, distribute, or publish.

How did Creative Commons begin?<\/h2>\n\n

Copyright law was developed to provide societies access to cultural works and to help incentivize creativity and innovation. <\/span>
\n\t <\/li>\n\t
To do so, policy makers created a period of time where a creator had a monopoly over their works before it became part of the public domain.<\/span>
\n\t <\/li>\n\t
In 1998<\/span> <\/span>US lawmakers passed the Sonny Bono Copyright Term Extension Act (CTEA)<\/a>, extending copyright for works by 20 years.<\/span>
\n\t <\/li>\n\t
This meant that rather than<\/span> <\/span>works entering the public domain 50 years after the death of the creator, it was now extended to 70 years. What gaps existed in copyright law?<\/h2>\n\n

Stanford law professor Lawrence Lessig sought to develop an alternative method to where works could be shared and adapted, but with creators still able to retain copyright.
\n\t <\/li>\n\t
This was becoming increasingly important as works were born digital and inherently meant to be shared.
\n\t <\/li>\n\t
He saught to challange the constitutionality of the Sonny Bonno Act in a case known as Eldred v. Ashcroft<\/a>. He lost the case.
\n\t <\/li>\n\t
Undeterred, Lessig and other scholars started a non-profit called Creative Commons in 2002, with the goal of developing licenses within the existing copyright framework to provide a spectrum of 'openness' for otherwise copyrighted works.
\n\t <\/li>\n\t

How do the licenses work?<\/h2>\n\n
There are three layers to a Creative Commons license:<\/p>\n\n

Legal code<\/strong>: this forms the basis of all licenses and is how CC works within the legal copyright framework. It is 'lawyer readable' language that describes the copyright terms that can be enforced in court.
\n\t <\/li>\n\t
Common deed<\/strong>: this is a 'human readable' webpage layout that outlines the terms of use for each license. These terms themselves are not enforcable in court, but summarize the legal code in plain language.
\n\t <\/li>\n\t
Design layer<\/strong>: this is a visual icon expressed in a 'machine readable' language called Creative Commons Rights Expression Language. Questions around what constitutes as an adaptation are dependent on applicable copyright law.<\/span> <\/span><\/li>\n\t
One exclusive right granted to creators is the right to create adaptations of their own works, sometimes called derivative works.<\/span><\/li>\n\t

Non-commercial use is understood to mean the intended use of a work is not for monetary gain or advantage.<\/span><\/li>\n\t
Reuse of a work also depends heavily on the context of the reuse. ShareAlike (SA):<\/strong> ShareAlike means the license permits adaptation or reuse of the work for any purpose, including commercial use.<\/span>
\n <\/p>\n\n
NonCommercial (NC): <\/strong>NonCommercial prohibits use of the work for financial gain.<\/span>
\n <\/p>\n\n

Waiver<\/strong>: <\/span>where copyright waivers are permitted, creators may use them to waive their rights to a work and donate it to the public domain.<\/span><\/li>\n\t
Fallback<\/strong>: where waivers are not enforceable, creators can use the public domain license to indicate they waive their copyright to the work and make it part of the public domain.<\/span><\/li>\n\t

What is a remixed work?<\/h2>\n\n

A remix is similar to an adaptation in that it uses parts of an existing work<\/strong>.<\/li>\n\t
A derivative is also considered a new work<\/strong> that is born out of an existing work.<\/li>\n\t
