9.1.2.1. The requirements for buildings<\/span> that are covered by this Part shall be determined by their occupancies<\/span> as regulated in the appropriate Sections in this Part.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

<\/p>\n\n

Occupancy<\/span><\/span><\/span><\/span> means the use or intended use of a building<\/span> or part thereof for the shelter or support of persons, animals or property.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

<\/p>\n\n

When looking at occupancy there are two parts:<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

What occupancy was the building originally designed for? <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n\n
If this is not known (which is possible, as multiple occupancies may have utilized the same structure over time), looking at the building department (building permits, original drawings, history of building) may be required.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

What is the occupancy on the date of inspection\/fire?<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n\n
How was the building being used on the day you inspected, or attended for a fire? After a fire this can also be challenging, and may require interviews with occupants.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

Exemptions<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
   9.1.2.2.  (1)  This Part does not apply to a building<\/span> that contains a residential occupancy<\/span>, consisting of no more than one dwelling unit<\/span>, and no other major occupancy<\/span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
<\/p>\n\n
Residential occupancy<\/span><\/span><\/span><\/span> means an occupancy<\/span> in which <\/span><\/span><\/span>sleeping accommodation is provided to residents who are not harboured for the purpose of receiving special care or treatment and are not involuntarily detained<\/span><\/span><\/span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Dwelling unit<\/span><\/span><\/span> means a suite operated as a housekeeping unit, used or intended to be used by one or more persons and usually containing cooking, eating, living, sleeping and sanitary facilities, and includes a residential unit.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Major occupancy<\/span><\/span><\/span><\/span> means the principal occupancy<\/span> for which a building<\/span> or part thereof is used or intended to be used, and includes the subsidiary occupancies<\/span> that are an integral part of the principal occupancy<\/span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

Breakdown:<\/span><\/span><\/span><\/span> This Part does not apply to a single dwelling unit of residential occupancy. Example: This Part does not apply to my house where I live as it contains np other occupancy, as is classified as a dwelling unit of residential occupancy.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

   (2)  Except for Article 9.4.5.5. and Sections 9.7 and 9.9, this Part does not apply to a building<\/span> or part of a building<\/span> that satisfies the requirements of the Building Code<\/span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
<\/p>\n\n
Building Code<\/span><\/span><\/span><\/span> means any version of the Ontario Building Code<\/span> that was in force at any time since it was made under The Building Code Act, 1974<\/span>, the Building Code Act <\/span>of the Revised Statutes of Ontario, 1980, the Building Code Act <\/span>of the Revised Statutes of Ontario, 1990, the Building Code Act, 1992 <\/span>or a successor to the Building Code Act, 1992<\/span>, and, where a specific version of the Building Code <\/span>is referred to, that version of the Building Code<\/span>.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

Except for Article 9.4.5.5. and Sections 9.7 and 9.9:<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Sprinkler systems<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
   9.4.5.5.  (1)  Buildings containing a home described in Clause 9.4.1.1.(1)(a) or (b) that is a care occupancy or a care and treatment occupancy shall be sprinklered in conformance with Sentences (2) to (5). <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Breakdown:<\/span><\/span><\/span><\/span> This section regarding sprinkler systems that have specific requirements regarding NFPA 13, NFPA 13R and NFPA 20, where sprinkler system design is designated in section 9.4.5.5. This is reflective of the schedule of compliance (timeline).<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
<\/p>\n\n
Section 9.7 Buildings with A Care Occupancy Or Retirement Home<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Breakdown: <\/span><\/span><\/span><\/span>Section 9.7 has its own specific requirements for a care occupancy or retirement home retrofit of this occupancy. Section 9.7 would be applied first. We will see a schedule of compliance for this occupancy. <\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
<\/p>\n\n
Section 9.9 Hotels<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Breakdown:<\/span><\/span><\/span><\/span> Again, section 9.9 has its own specific requirements. Where requirements require a building permit, the building code will apply to those specific sections.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

   (3)  Section 9.7 does not apply to a building<\/span> or part of a building<\/span> that contains a care occupancy<\/span>, if the building<\/span> or part of the building<\/span> satisfies the requirements for a care occupancy<\/span> contained in the Building Code<\/span> as it read at any time on or after April 6, 1998.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Breakdown:<\/span><\/span><\/span><\/span> If the building as described in section 9.7 was built, or under building permit on April 6, 1998, then retrofit is not required. Fire code maintenance under section Part 2 & 6 still apply. ***Inspections are still required.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

   (4)  Section 9.7 does not apply to a building<\/span> or part of a building<\/span> that contains a retirement home<\/span>, if the building<\/span> or part of the building<\/span> satisfies the requirements for a retirement home<\/span> contained in the Building Code<\/span> as it read at any time on or after January 1, 2014.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Breakdown:<\/span><\/span><\/span><\/span> If the building as described in section 9.7 was built, or under building permit on January 1, 2014, then retrofit is not required. Fire code maintenance under section Part 2 & 6 still apply. ***Inspections are still required.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

   (5)  Section 9.9 does not apply to a building<\/span> or part of a building<\/span> that satisfies the requirements of the Building Code<\/span> as it read at any time on or after July 1, 1993.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
Breakdown:<\/span><\/span><\/span><\/span> If the building as described in section 9.9 was built, or under building permit on July 1, 1993, then retrofit is not required. Fire code maintenance under section Part 2 & 6 still apply. ***Inspections are still required.<\/span><\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n
<\/p>\n\n
   (6)  Sections 9.2 to 9.9 do not apply to a building<\/span> with respect to which the Chief Fire Official<\/span> has granted an exemption under a predecessor of this Regulation during such period as the exemption is valid.<\/span><\/span><\/span><\/span><\/span><\/span><\/p>\n\n

Breakdown: <\/span><\/span><\/span><\/span>If an exemption has been granted, this should be documented and easily available to locate.
